Exclusion of Third Party Rights

The Contracts (Right of Third Parties) Act 1999 shall not apply to this Agreement and no person other than the parties to this Agreement shall have any rights under it, nor shall it be enforceable under that Act by any person other than the parties to it.

By accessing this Site, you agree that English law, including without limitation the provisions of the Evidence Act 1995 and the Electronic Communications Act 2000 shall govern such access as well as the above terms and you agree to submit to the exclusive jurisdiction of the English courts.

Any dispute relating in any way to your visit to this Site or to products you purchase through or from Arcangel shall be submitted to confidential arbitration in London, except that, to the extent you have in any manner violated or threatened to violate Arcangel’s intellectual property rights, Arcangel may seek injunctive or other appropriate relief in any state and you consent to exclusive jurisdiction and venue in such courts.

Arbitration under this Agreement shall be conducted under the rules then prevailing of the International Chamber of Commerce. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.

We reserve the right to make changes to our Site, policies, and these Terms and Conditions of Use at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
